Large office building on a 12-month ratchet. A single July afternoon when the chiller plant was brought back online after a maintenance outage set a new peak that is still billing. Interval data shows the 15-minute spike lasted less than 40 minutes and was 180 kW above the prior 11 months. Utility is applying the full ratchet. We have already calculated the excess demand charge at $18,600 over the remaining ratchet window. Has anyone successfully argued a “maintenance-related non-recurring peak” exception, or is the only path a formal dispute with the load profile attached?
