Does anyone have a good reference chart showing statute of limitations for utility billing disputes by state? I'm expanding my practice beyond South Carolina and could really use a quick reference. Dominion Energy here in Charleston typically gives us 24 months but I know it varies widely by jurisdiction.
Statute chart by state - anyone have this?
George, I've been meaning to put something like that together for years but never got around to it. Georgia is generally 4 years under contract law but Georgia Power's tariff limits refunds to 2 years. It's a constant battle.
Oregon gives us 4 years by statute but the utilities always start at 2 years per their tariffs. I think most states fall into the 3-6 year range for contract disputes but utility tariffs try to limit it further.
That's what I'm seeing too. Maybe we should crowdsource this as a group project? Everyone could contribute their state's rules and we could build a comprehensive reference.
Great idea George. I'd be happy to coordinate something like that. Tennessee is 6 years by statute but MLGW and other utilities here usually settle at 3-4 years to avoid formal proceedings. Let's start a master spreadsheet.
