APS is now claiming they only have to go back 2 years on billing corrections, citing some internal policy change. This is for a clear tariff misapplication on a Schedule E-32 customer where they've been billing the wrong time-of-use periods. Arizona statute is 6 years for written contracts. Has anyone else run into this new 2-year position from APS? Seems like they're just trying to limit their exposure.

Sarah, I haven't hit that with APS yet but TEP tried something similar last year. I had to threaten ACC action to get them to honor the full statute. Internal utility policies don't override state law. The 6-year contract statute should apply to tariff agreements. Have you escalated beyond their billing department?
Omar, I'm working with their regulatory affairs group now. They keep citing "standard industry practice" but can't point to any regulation that limits billing corrections to 2 years. The overcharge is about $15K over 4 years so it's worth fighting. May have to file with ACC if they won't budge.
Definitely worth the ACC filing for that amount. I'd also check if there's any case law in Arizona on utility billing correction timeframes. Sometimes they back down when they realize you're serious about regulatory action.
