Dale, I can share some general guidelines. Key sections: detailed scope of work, contingency fee structure, payment terms (I use 30 days), limitation of liability, and termination clauses. For Duke Energy Carolina customers, I always include specific language about demand charge analysis and power factor corrections.
Wayne, that's helpful. What do you typically use for contingency percentages? I've seen everything from 20% to 50% mentioned in forums. Also wondering about minimum fee clauses for smaller recoveries.
Dale - I use 25% for recoveries over $5K, 30% for smaller amounts, with a $500 minimum fee. For Xcel Energy territory in Colorado, I also include specific language about renewable energy credits and time-of-use rate analysis. Happy to email you my template if you want to PM me.
