Working on an engagement with Alabama Power customer who has multiple meters and suspects tampering or faulty readings going back 2+ years. What kind of specific language do you all include in your LOA when meter accuracy is the primary concern? I want to make sure I'm covered if they need to bring in outside meter testing services or if we end up in formal dispute proceedings.
LOA language for disputed meter readings?
Albert, I always include a clause that allows for "additional technical services as required" with client pre-approval for costs over $500. PPL here in Pennsylvania charged $850 last year for independent meter testing on a case I was working. Also make sure your LOA specifies who pays those costs - client directly or comes out of contingency fee if we win.
Had a similar situation with Idaho Power couple years back. Meter was reading 20% high for 18 months. One thing I learned - make sure your engagement letter covers the possibility of criminal charges if tampering is discovered. Client needs to understand that meter tampering can become a law enforcement matter, not just a billing dispute.
Warren brings up a good point about the criminal aspect. Down here in Texas, CenterPoint Energy takes meter tampering very seriously. I include language that my role is limited to bill analysis and that any suspected tampering will be reported to the utility as required. Don't want to get caught in the middle of a fraud investigation.
All good points here. Albert, one more thing - if you suspect systematic meter problems affecting multiple customers, some utilities have formal programs for mass meter testing. Duke Energy Ohio has done this a few times. Your LOA should allow for participating in utility-sponsored testing programs if the opportunity arises. Can lead to much bigger recoveries.
