New York backbilling - ConEd going back 6 years

ConEd in Rochester trying to backbill manufacturing client 6 years claiming CT multiplier was wrong the whole time. They want $180,000 for underbilled demand charges on Schedule 19 service. New York PSC allows backbilling up to 6 years but only for proven customer fraud or negligence. This looks like utility equipment error to me but ConEd is being aggressive. Anyone had success limiting these extended backbills in New York?
Dana, I had a similar case with Georgia Power but different state rules obviously. The key question is who installed and maintained the CT equipment. If ConEd installed it and never caught the multiplier error during routine maintenance, that should limit their recovery period. New York PSC is generally customer-friendly if you can show utility negligence.
Check ConEd's inspection and testing records for that CT installation. In Tennessee we've seen utilities claim 6-year periods but their own records show they should have caught equipment errors during required testing cycles. If they missed multiple opportunities to identify the problem, PSC usually limits the backbill period significantly.
