NV Energy mistake - charged commercial rate for demand spike

Kim here from Las Vegas. Need some advice on a billing dispute with NV Energy. Small office building had an HVAC malfunction that caused demand to spike to 127 kW for about 10 minutes during June heat wave. Normal demand is around 45 kW. NV Energy billed them on the GS-2 commercial rate instead of their usual GS-1 small general service rate. The spike put them over the 50 kW threshold. Is this legitimate or can we fight it?
Walt from Pittsburgh here. Unfortunately, that's usually how it works. Most utilities have automatic rate reclassification based on demand thresholds. If you hit over 50 kW demand, even for a brief period, you get bumped to the higher rate class for that billing cycle. Some utilities give you a grace period for equipment malfunctions, but you'd need to file a formal complaint with documentation that it was an equipment failure, not normal operation.
Amir here from Memphis. Had a similar situation with MLGW a few years ago. The key is proving it was an equipment malfunction and not just higher usage. You'll need repair records, maintenance logs, anything showing the HVAC system wasn't operating normally. MLGW reversed the rate reclassification once we provided documentation from the HVAC contractor showing the failed component. Worth fighting if you have the paperwork.
