James, demand to see their tamper investigation report and photos. They have to prove tampering occurred. Also get the meter test data - if the meter was actually running slow, they'll have records.
Vernon's right. I fought a similar case with Xcel last year. Their "evidence" was just usage patterns that looked odd. When we demanded actual proof of physical tampering, they couldn't produce anything and dropped the backbill.
Also check if they're claiming theft or just billing adjustment. Different burden of proof. For theft accusations they need clear evidence of intentional bypassing or meter manipulation.
Thanks everyone. Demanded the investigation report and meter test data. Xcel admitted they don't have photos or test results showing tampering - just "suspicious usage patterns." Fighting this through Colorado PUC now.
Good approach James. Usage patterns alone aren't evidence of tampering. The PUC will want to see actual physical evidence or meter test data showing manipulation. Keep us posted on how it turns out.
