Alabama Power backbill nightmare

Mobile shipyard got Alabama Power backbill for $230,000 going back 8 years. Claiming CT was wrong from initial install in 2016. Alabama PSC allows this?
Alabama allows up to 4 years but only if utility can prove customer should have known. 8 years is way beyond statutory limits even for fraud cases.
Had similar case with Mississippi Power. Started at 6 years but got it down to 30 months. Alabama Power is notorious for trying these extreme backbills.
They're claiming bills should have been obviously higher based on similar facilities. But client's usage actually dropped due to efficiency improvements in 2018.
Document the efficiency improvements! That's your smoking gun. If usage legitimately dropped, there's no way customer should have suspected CT error.
Great point Leah. We have LED retrofit records and new compressor installs. Alabama Power trying to negotiate down to 5 years but we're pushing for 36 months max.
Stick to your guns Kevin. With efficiency improvements documented, they can't claim customer knowledge. 36 months is generous for their CT error.
Alabama PSC regulations cap backbilling at 48 months maximum, and that's only with clear evidence of customer knowledge. Efficiency improvements that explain usage patterns defeat any "customer should have known" claims.
