Client in Newark got hit with PSE&G backbill for $47,000 going back 7 years. They claim meter was reading low due to faulty multiplier. N.J.A.C. 14:3-7.6 says 2 years max for utility error. Am I reading this right?
You're correct Tony. NJ is 24 months maximum backbilling for utility equipment failure. PSE&G is pushing their luck here. File a complaint with BPU.
Had same issue with PSE&G in 2008. They backed down when I cited the regulation. Make sure you have documentation that the error was their equipment, not customer tampering.
In Arizona we get 3 years but only if customer caused the problem. Equipment failure is 2 years. Every state is different but NJ is definitely 2 years for utility error.
New Jersey's 24-month rule in N.J.A.C. 14:3-7.6 is clear: utility equipment errors cannot be backbilled beyond 2 years. Document everything and file with the BPU if PSE&G won't withdraw the invalid charges.
